Polemik Atas Konsep "Hukum Yang Hidup" Dalam Pembaharuan KUHP di Indonesia

Abstract

This study aims to analyze the Polemic of the Concept of Living Law and Adat Law in the Renewal of Criminal Law in Indonesia. This research uses normative juridical research methods with descriptive specifications. The analysis method used in this study is a comparative approach analysis. In fact, the concept of living law that is not the same as customary law needs to be understood by the entire community, especially in enforcers and legal experts in Indonesia, lest the meaning of foreign law is stronger than the original Indonesian law, namely adat law.
